END-USER LICENSE AGREEMENT (EULA)

1. ACCEPTANCE OF TERMS

This End-User License Agreement (“Agreement”) is a legal contract between you (“User”) and Metalne Konstrukcije 037, located at Istočna Obilaznica 4, 37201 Kruševac, Serbia (“Company”). By installing, accessing, or using the application (“Application”), you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.

2. LICENSE

The Company grants you a limited, non-exclusive, non-transferable license to use the Application strictly in accordance with the terms of this Agreement.

3. RESTRICTIONS ON USE

The User shall not:

  • Modify, adapt, or create derivative works based on the Application.
  • Reverse engineer, decompile, or attempt to extract the source code of the Application.
  • Distribute, sell, rent, or sublicense the Application to any third party.
  • Use the Application in any manner that violates applicable laws or regulations.

4. OWNERSHIP

The Application and all related intellectual property, including but not limited to software code, images, design, and trademarks, are owned by the Company and are protected by copyright and other relevant laws.

5. UPDATES AND SUPPORT

The Company reserves the right to update or modify the Application at any time and may discontinue support for the Application without prior notice.

6. DISCLAIMER OF WARRANTIES

The Application is provided “as is,” without warranties of any kind, whether express or implied. The Company disclaims all warranties, including, but not limited to, warranties of functionality, fitness for a particular purpose, and non-infringement.

7. LIMITATION OF LIABILITY

The Company shall not be liable for any damages, including direct, indirect, incidental, consequential, or punitive damages, arising out of the use or inability to use the Application, even if the Company has been advised of the possibility of such damages.

8. TERMINATION

This Agreement will automatically terminate if you violate any of its terms. Upon termination, you must immediately cease using the Application and delete all copies from your devices.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.

UGOVOR O LICENCIRANJU KRAJNJEG KORISNIKA (EULA)

1. PRIHVATANJE USLOVA

Ovaj Ugovor o licenciranju krajnjeg korisnika (“Ugovor”) je pravni ugovor između vas (“Korisnik”) i kompanije Metalne Konstrukcije 037, sa sedištem u Istočnoj Obilaznici 4, 37201 Kruševac, Srbija (“Kompanija”). Instaliranjem, pristupanjem ili korišćenjem aplikacije (“Aplikacija”), potvrđujete da ste pročitali, razumeli i prihvatili sve uslove ovog Ugovora.

2. LICENCA

Kompanija vam dodeljuje ograničenu, neisključivu, neprenosivu licencu za korišćenje Aplikacije isključivo u skladu sa odredbama ovog Ugovora.

3. OGRANIČENJA KORIŠĆENJA

Korisnik ne sme:

  • Modifikovati, prilagođavati ili stvarati izvedene radove na osnovu Aplikacije.
  • Vršiti obrnuti inženjering, dekompilaciju ili pokušavati da izvadi izvorni kod Aplikacije.
  • Distribuirati, prodavati, iznajmljivati ili sublicencirati Aplikaciju bilo kojoj trećoj strani.
  • Koristiti Aplikaciju na način koji krši bilo koje važeće zakone ili propise.

4. VLASNIŠTVO

Aplikacija i svi povezani autorski radovi, uključujući, ali ne ograničavajući se na, softverski kod, slike, dizajn, i zaštitne znakove, su vlasništvo Kompanije i zaštićeni su zakonima o autorskim pravima i drugim relevantnim zakonima.

5. AŽURIRANJA I PODRŠKA

Kompanija zadržava pravo da u bilo kom trenutku ažurira ili izmeni Aplikaciju, kao i da obustavi podršku za Aplikaciju bez prethodnog obaveštenja.

6. ODRICANJE OD ODGOVORNOSTI

Aplikacija se pruža “kako jeste”, bez bilo kakvih garancija, bilo izričitih ili implicitnih. Kompanija se odriče svih garancija, uključujući, ali ne ograničavajući se na, garancije o funkcionalnosti, pogodnosti za određenu namenu i nepovredivosti.

7. OGRANIČENJE ODGOVORNOSTI

Kompanija neće biti odgovorna za bilo kakvu štetu, uključujući direktnu, indirektnu, slučajnu, posledičnu ili kaznenu štetu, proisteklu iz korišćenja ili nemogućnosti korišćenja Aplikacije, čak i ako je Kompanija bila obaveštena o mogućnosti takve štete.

8. PRESTANAK UGOVORA

Ovaj Ugovor će automatski prestati da važi ako prekršite bilo koji od njegovih uslova. U slučaju prestanka, morate odmah prestati sa korišćenjem Aplikacije i ukloniti sve njene kopije sa svojih uređaja.

9. PRIMENJIVO PRAVO

Ovaj Ugovor se uređuje i tumači u skladu sa zakonima Republike Srbije, bez obzira na sukob zakonskih odredbi.
